Legislation Introduced by Senator Pace


SB1210: assisted living; caregivers; training

1. Requires an individual to complete either of the following to obtain a certification as an assisted living facility caregiver: a) 62 hours of on-the-job training under the direct supervision of specified health professionals or a certified assistant living facility manager with at least five years of experience, and successful completion of the required NCIA Board exam with at least a 75 percent score; or b) completion of the required curriculum and NCIA Board exam.
2. Specifies that only 31 of the 62 hours of on-the-job training may be under the direct supervision of a certified assisted living facility manager.
3. Directs the NCIA Board to prescribe standards by rule for on-the-job training. FACT SHEET S.B. 1210 Page 2 4. Defines direct supervision as the on-site, in-view observation and guidance of an assisted living facility caregiver who is in training by a supervising health professional.

SB1209: students; data; accessibility; governance commission

Requires ADE to adopt policies that allow county school superintendents, SBE and the ASBCS access to student-level data for students currently enrolled in a school that is within their jurisdiction. Requires ADE to develop and publish policies, as defined by interagency data-sharing agreements, to comply with FERPA and other relevant privacy laws, including those that manage access to personally identifiable information to be implemented by ADE, county school superintendents, SBE and the ASBCS. 

SB1208: registered dietitian nutritionists; title; orders

Allows a person to use the titles dietician, dietitian, certified nutrition specialist, registered dietitian (RD), registered dietitian nutritionist (RDN) or their abbreviations only if that person has the appropriate credentials from the Commission on Dietetic Registration (CDR) to use the designation. 

SB1142: nonhealth professions; occupations; regulations.nonhealth professions; occupations; regulations.

Modifies criteria for the regulation of nonhealth professions and occupations and adds requirements for legislative committees of reference (CORs). Defines terms relating to professional and occupational regulation.

SB1137: pharmacy board; permittee operations; fees

Clarifies the definitions of unethical conduct and unprofessional conduct as they relate to Board of Pharmacy licensees and permittees. Permits the Board to establish a credit-card convenience fee for use of the Board's online application process

SB1136: apprenticeships; funeral directors; embalmers; cremationists

Allows an applicant for an intern license or cremationist license to complete an apprenticeship that is approved by the U.S. Department of Labor (U.S. DOL) or the Department of Economic Security (DES) as a qualification for licensure. 

SB1129: real estate; employee; rent collection.

Allows an unlicensed person to collect rent and related fees in person for the use of real estate as part of the person's clerical duties if the person works for a licensee, collects the rent on the licensee's behalf and a receipt is provided upon payment.

SB1114: limited liability companies statute corrections

1. Removes the ACC's authority to commence a proceeding to administratively dissolve an LLC if the principal address the LLC provides is not in Arizona.
2. Updates statutory references to remove references to statutes set to be repealed on September 1, 2020, and replace with references to the 2019 Act.
​3. Corrects a defective reference relating to the liability of an LLC member who wrongfully dissociates to other LLC members.

SB1096: property management records; residential rentals

​Clarifies related documents that a property management firm must store for the specified time frame. Requires a property management firm to keep required records in the broker's main office or branch office, electronically or at an off-site storage location in Arizona.

​SB1095: controlled substances; schedule designations

Directs the Board to adopt the Schedule I, II, III, IV and V controlled substances as listed in the CSA and requires the Board to amend Board rules, as necessary, to reflect any changes in the schedule designations.
